Sacked Ondo Rep goes to Supreme CourtThe lawmaker representating Akure North and South Federal Constituency of Ondo State in the House of Representatives, Ifedayo Abegunde, who was sacked by the Court of Appeal sitting in Akure yesterday filed a notice of appeal challenging the decision at the Supreme Court, Abuja.
He also prayed the apex court to stay the execution of the judgement of the appellate court. The Court of Appeal had on Monday upheld the decision of the lower court ordering Abegunde to vacate his seat.
Abegunde had approached the appellate court to set aside the verdict of Justice G.O. Okeke of the Federal High Court, Akure, which had earlier declared his seat vacant in May 2012.
The lawmaker, a former member of the Labour Party (LP), had defected to the defunct Action Congress of Nigeria (ACN) claiming that his former party was embroiled in crisis, which eventually led to division.
However, the Appeal Court presided by Justice A. G. Mishella held that Abegunde’s appeal lacked merit and ordered him to vacate his seat.
But the lawmaker averred that the appellate court erred in law by affirming the High Court interpretation of the 1999 Constitution of the Federal Republic of Nigeria (as amended).
